1974 NASCAR International Stock Car Racing Rule Book
Section 15 -- National Stock Car Racing Commission Appeals

1. National Stock Car Racing Commission is established to rule on appeals. The Commission shall consist of 12 members.

The Chairman of the Commission shall be the administrative member. The Chairman shall designate an alternate chairman who shall, in the event of death, retirement, or incapacity of the Chairman perform the duties of the chairman until a successor is designated by NASCAR or until the Chairman is able to resume his duties as Chairman.

The Commission shall hold an organizational meeting in February of each year which shall be called by the Chairman.

The Commission shall meet at such places and at such times as are necessary for the efficient and speedy disposition of its business. Three members constitute a quorum, except for the organizational meeting when seven members shall constitute a quorum.

In conducting a hearing the Commission shall not be bound by technical or formal rules of procedure except as provided herein, but shall conduct hearings in such manner as to best ascertain the rights of all parties to the proceedings under these rules.

The Commission may enact its own rules for the conduct of hearings, and the prescribed manner in which appeals may be decided.

All appeals shall be docketed when received at National Headquarters and shall be set for hearing in the same order as docketed.

In the event a Commission member is involved in an appeal, the Commission member shall disqualify himself from participating as a Commission member on the appeal and the remaining Commission members shall select a replacement.

A majority of the members of the Commission present must concur to modify any penalty or determine any appeal. If the Commission fails to agree on action to be taken on an appeal, the appeal shall be referred to the NASCAR National Stock Car Racing Commissioner for decision.

Members may appear in person at hearings before the Commission. All testimony before the Commission shall be under oath. When testimony is taken, the testimony shall upon motion of either party or the order of the Commission, be taken down in writing and filed in the proceedings.

2. In each appeal the relevant item shall be the correctness of the ruling by the NASCAR official involved in light of the facts and not the results of the ruling.

3. If the Commission determines that the proceedings in respect to any appeal have been instituted or continued without reasonable grounds, the cost of such proceedings shall be assessed against the member who instituted or continued such proceedings.
