An office for the National Stock Car Racing Commissioner shall be maintained at NASCAR Headquarters, Daytona Beach, Fla., and a fund will be maintained for the operation of this office. The National Stock Car Racing Commissioner will serve for $1 per year. The National Stock Car Racing Commissioner shall be nominated and appointed as follows: The NASCAR President will name a committee of three to select a candidate for appointment and the action of the committee will be subject to the ratification of at least 10 promoters of NASCAR sanctioned events. If an appeal pursuant to this Section is received by NASCAR Headquarters during the vacancy in the office of National Stock Car Racing Commissioner or during the incapacity of the Commissioner, then the President of NASCAR shall appoint an Acting National Stock Car Racing Commissioner to consider that appeal in accordance with this Section. Members of the nominating committee will consist of one NASCAR official and two promoters of NASCAR sanctioned events. The office of National Stock Car Racing Commissioner is established to provide a supreme authority for the administration of orderly procedures in automotive events and the enforcement of the provisions of the Rule Book. The Commissioner shall be the final appellate authority with regard to a violation of these rules, specifications, entry blank terms, or disciplinary procedures, and any affected member may as a matter of right appeal any decision of the National Stock Car Racing Commission in accordance with the following procedure: a. An appeal shall be in writing and filed with Russ Moyer, Chairman, National Stock Car Racing Commission, at NASCAR Headquarters within 20 days of the decision of the Commission together with a $100.00 appeal fee. b. The Commissioner shall conduct a hearing on the appeal at the earliest practicable date, notifying the parties of said appeal and hearing. Date and place of hearing shall be determined by the National Stock Car Racing Commissioner. c. Members may appear in person at hearings before the Commissioner. All testimony before the Commissioner shall be taken under oath. When testimony is taken, the testimony shall, upon motion of either party or by order of the Commissioner, be taken down in writing and filed with the proceedings. d. Hearings before the Commissioner shall be conducted under the rules promulgated by the Commissioner. e. All decisions of the Commissioner shall be final. f. If the Commissioner determines that the proceedings in respect to any appeal have been continued by a protesting member without reasonable grounds, the cost of such proceedings shall be assessed against the protesting member who continued the proceedings.
