1. All members of NASCAR are subject to disciplinary action by NASCAR for violation of NASCAR Rules. 2. For a violation of NASCAR Rules occurring during an event which the NASCAR official in charge of the event determines involves the safety of participants and spectators, said official is authorized to summarily disqualify, fine, suspend, or eject the violator from the racing premises. Examples of conduct warranting summary action include the consumption of alcoholic beverages in the pit and garage areas during an event, use of drugs as prohibited herein, fighting and reckless driving. Violations of NASCAR Rules for which summary action is taken by the NASCAR official in charge of the event must be reported to NASCAR Headquarters. The penalized member may appeal the penalty to the NASCAR Competition Director, whose decision thereon may in turn be appealed by the member to the NASCAR National Stock Car Racing Commission, provided the member delivers a written appeal, along with a $100.00 appeal fee, to the Commission Office at NASCAR Headquarters within thirty days after the event. (See Section 15). 3. Violations of NASCAR Rules for which summary action is not taken by the NASCAR officials in charge of the event shall be reported in written detail to Lin Kuchler, Competition Director, at NASCAR Headquarters for adjudication. Members will be informed of disciplinary action in writing (a "Penalty Notice") by the Competition Director's office. The decision of the NASCAR Competition Director may be appealed by the member to the NASCAR National Stock Car Racing Commission, provided the member delivers a written appeal, along with a $100.00 appeal fee, to the Commission Office at NASCAR Headquarters within thirty days of the issuance of the penalty notice by the NASCAR Competition Director's office. (See Section 15). 4. Unless the Penalty Notice specifies otherwise, all unpaid fines shall be deducted at the end of the racing season from any point fund monies earned by the member to whom the Penalty Notice has been issued. (Any fines left unpaid at the end of the racing season shall be considered grounds for automatic indefinite suspension of the member against whom the unpaid fine has been assessed). 5. Penalties for violation of NASCAR Rules are determined by the gravity of the violation and its effect on the safety and good reputation of stock car automobile racing. Such penalties may include disqualification, suspension, fines, and/or loss of points, except as otherwise provided in NASCAR Rules and except as more specifically provided below: a. Any member who performs an act or participates in actions deemed by NASCAR officials as detrimental to the sport or to NASCAR shall be fined not less than $25.00 and may also be suspended and/or lose all accumulated points. b. Any member who assaults or threatens to do bodily harm to any NASCAR official or persons serving under his direction shall be suspended and/or fined and may lose all accumulated points. Fine not to exceed $500.00. c. Any member who participates in fights in pits, on track or on race premises shall be fined a minimum of $100.00 and may also be suspended. d. Any member who commits an assault with a weapon in pits, on track or on race premises shall be fined a minimum of $250.00 and may also be suspended and/or lose all accumulated points. e. Any member who, while participating in a NASCAR sanctioned event, partakes of any alcoholic beverage, stimulating or tranquilizing drug shall be immediately ejected from the racing premises and shall be subject to mandatory fine of not less than $25.00 and not more than $500.00 and shall be suspended. f. Any member who permits someone else to use his competitor or pit permit shall be fined not less than $25.00 and/or be disqualified. g. Any member who permits someone else to use his NASCAR license shall be fined not less than $25.00 and suspended. Any member who uses a license other than his own is also subject to fine and suspension. h. Any member who signs the NASCAR release sheet or competitor or pit permit for anyone other than himself shall be fined not less than $25.00. i. Except for Winston Cup Grand National, other Grand National, or any other events for which Entry Blanks are published by NASCAR Headquarters, any NASCAR member, licensed as a driver or car owner, who files an entry or in any way commits himself to compete in such an event and fails to do so without seeking and receiving the prior consent of the NASCAR Competition Director at least 24 hours before the event, may be subject to any one or more of the following penalties for each such failure to compete, whether or not he takes part in another motor sports event on the same day: (a) a minimum charge of $25.00, (b) loss of all NASCAR championship points for the year in which the failure to compete occurs, or (c) indefinite suspension. j. In Winston Cup Grand National, other Grand National or any other events for which Entry Blanks are published by NASCAR Headquarters, any NASCAR member, licensed as a driver or car owner, who files an entry or in any way commits himself to compete in such an event and fails to do so without seeking and receiving the prior consent of the NASCAR Competition Director at least 24 hours before the event, may be subject to any one or more of the following penalties for each such failure to compete, if he does not take part in another motor sports event on the same day: (a) a minimum charge of $50.00, (b) loss of all NASCAR championship points for the year in which the failure to compete occurs, or (c) indefinite suspension; however, if said drive(r) or car owner fails to compete as heretofore described and takes part in another motor sports event on the same day he may be subject to any one or more of the following penalties: (a) a minimum charge of $200.00, (b) loss of all NASCAR championship points for the year in which the failure to compete occurs, or (c) indefinite suspension. 6. Any NASCAR member against whom a Penalty Notice is issued shall have the right to a hearing before the NASCAR Competition Director or his designee at NASCAR Headquarters or wherever NASCAR may designate, provided the member mails a request for such hearing to the NASCAR Competition Director at NASCAR Headquarters within 10 days from the receipt of the Penalty Notice along with a $100.00 hearing fee. In such hearing, such member shall have the right to appear in his own behalf and to present witnesses and documentary evidence. If, the hearing decision of the NASCAR Competition Director or his designee is unacceptable to the member requesting the hearing, then the member shall have the right to appeal the decision of the NASCAR Competition Director or his designee to the National Stock Car Racing Commission, provided the member delivers a written appeal, along with a $100.00 appeal fee to the Commission Office at NASCAR Headquarters within thirty days of the issuance of the decision of the NASCAR Competition Director or his designee (See Section 15). 7. All Penalty Notices issued by the NASCAR Competition Director and rulings thereon by the NASCAR Competition Director or his designee shall be in writing and shall be mailed to the affected member at his last known address as reflected in the NASCAR Headquarters files.
