1. Every NASCAR member who participates in a NASCAR sanctioned event as a driver, car owner, mechanic, official, or industrial representative must also possess a valid, current NASCAR license authorizing participation as such. 2. NASCAR licenses shall be issued to qualified applicants without charge by NASCAR upon receipt by NASCAR Headquarters of the appropriate fully executed and signed official NASCAR membership and license application form (seperate application forms are available for competitor, industrial, car sponsor and official-promoter membership and license), the riquired [sic] membership dues, a fully executed and signed Benefit Plan Registration Release and Indemnity Agreement, and a fully executed and signed minor's release if applicant is under 21 years of age. (NOTE: Competitor license sometimes referred to as a "Competition license.") 3. NASCAR reserves the right to approve or reject any and all license applications. NASCAR licenses are reviewed from month to month, and automatically renewed if approved by NASCAR. NASCAR reserves the right to terminate any license at the end of any month by written notice to the member. Members may discontinue their NASCAR membership at any time by surrendering their competition licenses, accompanied by their letter of resignation, to NASCAR Headquarters. 4. No license will be issued until a fully completed and signed Benefit Plan Registration Release and indemnity Agreement has been received at NASCAR Headquarters. Any applicant for a license who is under 21 years of age must have the Minor's Release on the membership and license application signed by both living parents and both signatures must be witnessed. If only one parent is living, the Minor's Release must carry that parent's signature which must be witnessed. If both parents are not living, the Minor's Release must be signed by a court-appointed legal guardian and must be accompanied by a certified copy of the court order which names him as the applicant's legal guardian. The signature of the legal guardian also must be witnessed. 5. A license may be used only by the member to whom it is issued and any member who allows any other person to use, or attempt to use, his license in any manner shall be subject to disciplinary action as hereinafter provided. 6. TO SECURE A NASCAR COMPETITOR LICENSE AS A RACE DRIVER, A NASCAR MEMBER MUST: a. Hold a valid automobile driver's license in his home state, and be at least 16 years of age or the minimum age required by the law of the state or states in which he competes, whichever age is older. b. Submit to and pass driving ability tests conducted by and at the discretion of NASCAR officials, whose decision as to the applicant's driving ability is final and binding on the applicant. c. Submit to a physical examination, when this is deemed necessary by NASCAR officials, and to be certified by the examining physician as being physically fit for race driving. d. The possession of an FIA license is a requisite for eligibility to participate in FIA-approved events. The FIA rule in this regard states: FOR DRIVERS' LICENSES V-7. Conditions of an FIA license: The possession of an FIA license is a requisite for eligibility to participate in FIA-approved events. The member Club is empowered to issue an FIA license. ACCUS-FIA may refuse to issue a license without stating any reason for such refusal. Furthermore, it may suspend or revoke a license in accordance with the provisions of the FIA Code following a hearing of the circumstances in accordance with appeal procedures published by the ACCUS-FIA Board or a committee appointed by the Board. Upon request of a member club, the ACCUS-FIA may suspend, revoke or refuse to renew an FIA license held by a person under suspension by his member club. The five member organizations must notify ACCUS-FIA immediately when one of their drivers has his club competition license withdrawn. V-8. Acceptance or refusal of entries: The possession of an FIA license in no way guarantees the holder a blanket acceptance to compete. A sanctioning body has every right to solicit entries by invitation to FIA licenseholders [sic] regardless of their club affiliation. Conversely, as sanctioning body may refuse or exclude any entrant without stating any reason. This refusal is final and without appeal, but notification of refusal must be made by the sanctioning body within 8 days of receipt of entry and not less than 4 days before commencement of the event, unless the Supplementary Regulations state otherwise. 7. NASCAR CAR OWNER COMPETITOR LICENSE REQUIREMENTS: a. To secure a NASCAR license as a car owner, a NASCAR member must be at least 16 years of age or the minimum age to hold a driver's license as required by the law of the state or states in which he competes, whichever age is older. b. All cars taking part in NASCAR sanctioned events must be registered and licensed by NASCAR Headquarters, regardless of whether or not a licensed driver owns a car. c. Car numbers will be assigned by NASCAR Headquarters. Whenever possible, requested number will be assigned but NASCAR reserves the right to issue all numbers in order to prevent duplication and maintain proper records. d. In event a car is owned by a partnership or corporation, license will be issued to one person only. But corporate name may also appear on the membership application and license, and all point fund money will be issued in the name of the corporation. e. Owner of a registered car may transfer license to a replacement car upon sale or destruction of original licensed car. If a registered owner requests transfer of his car registration to another name, request must be made to NASCAR Headquarters in writing. f. No license is transferable except as provided in sub-paragraph "e" immediately above. g. If a licensed car is sold, new owner shall file a car owner application with NASCAR Headquarters and a new license and car number will be issued. h. If a licensed car is sold, new owner may be allowed to use the old car number with written permission of original registered owner. i. When a registered car is sold, NASCAR Headquarters shall be notified immediately of sale and to whom car has been sold. Violation of rules relative to any car sold without notice to NASCAR Headquarters may subject original registrant to suspension and/or loss of points. j. NASCAR assumes no responsibility in event of error in scoring or point tabulation if number other than that officially assigned by NASCAR is used. k. It is not necessary for licensed car owner to secure additional mechanic's license. l. All car owners entering NASCAR-FIA listed events must possess a current, valid FIA Entrant's license. 8. TO SECURE A NASCAR COMPETITOR LICENSE AS A MECHANIC, A NASCAR MEMBER MUST: a. Be at least 16 years of age or the minimum age to hold a driver's license as required by the law of the state or states in which he competes, whichever age is older. b. Submit to a physical examination when this is deemed necessary by NASCAR officials and be certified by the examining physician as being physically fit to be a race mechanic. 9. TO SECURE A NASCAR LICENSE AS AN INDUSTRIAL REPRESENTATIVE OR CAR SPONSOR, A NASCAR MEMBER MUST: a. Be at least 16 years of age or the minimum age to hold a driver's license as required by the law of the state or states in which he attends NASCAR sanctioned events, whichever is older. b. Be a representative of a firm which posts awards, sponsors cars or renders services approved by NASCAR. (1) Industrial Service licenses are issued to representatives of firms who service their products or perform other services at NASCAR sanctioned events. (2) Industrial Observer licenses are issued to representatives of firms, including publicity and public relations personnel, who do not engage in the servicing of products. Possession of Industrial Observer license does not automatically qualify licenseholder [sic] for garage privileges. (3) Car Sponsor licenses are issued to persons or corporations involved in the ownership or financial support of a registered car and whose name or product name may be displayed on a race car. 10. TO SECURE A LICENSE AS A NASCAR OFFICIAL, A NASCAR MEMBER MUST: a. Be at least 18 years of age or the minimum age limit to hold a driver's license as required by the law of the state or states in which he officiates at NASCAR events. b. Submit a letter of recommendation signed by a NASCAR field representative attesting to applicant's qualifications and abilities as a race official, accompanied by a statement that an assignment is available for the applicant as a NASCAR official at a future NASCAR sanctioned event, if the application is approved by NASCAR. c. Possess, in the opinion of the interviewing NASCAR official, the necessary qualifications and abilities to carry out the duties of a NASCAR official. d. Furnish a completed official's agreement with license application and Benefit Plan Registration Release and Indemnity Agreement. e. Submit to a physical examination when this is deemed necessary by a NASCAR officer and be certified by the examining physician as being physically fit for performing the duties of an official. 11. TO SECURE A LICENSE AS A NASCAR PROMOTER, A NASCAR MEMBER MUST: a. Be at least 16 years of age or the minimum age limit to hold a driver's license as required by the law of the state or states in which he promotes NASCAR sanctioned events. b. Be affiliated with a race track which presents NASCAR sanctioned events. 12. THE FOLLOWING PROCEDURES GOVERN USE OF LICENSES AT NASCAR SANCTIONED EVENTS: a. Drivers and car owners, when signing in for any event, must turn in NASCAR license to NASCAR official in charge of the event. b. Licenses will be returned when drivers receive prize money or at time and place specified by NASCAR official in charge of the event. c. License of competitors injured in, or suspended during running of event will be forwarded to NASCAR Headquarters and returned upon proof of ability to drive or lifting of suspension.
